Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fancav platform, including the website at fancav.com and all related services (collectively, the "Service"), operated by Fancav ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a notice within the Service and require you to re-acknowledge the updated Terms before continuing to use the platform. Continued use after notice constitutes acceptance.

1. Eligibility

You must be at least 18 years of age to create a personal account or use the Service. By registering, you represent and warrant that you meet this requirement. We verify age at signup using the date of birth you provide and enforce this requirement server-side. Providing a false date of birth is a violation of these Terms and may result in immediate termination of your account.

Business accounts do not require age verification of the venue operator.

2. Account Registration

2.1 Personal Accounts

To create a personal account, you must provide accurate and complete information including your first and last name, email address, date of birth, gender, phone number, and home address. You may register using an email address and password or via Google OAuth. Regardless of signup method, you must complete all required profile fields before accessing the platform.

2.2 Business Accounts

Businesses such as bars, restaurants, sports bars, and breweries may register for a business account by providing their business name, venue type, business address, contact person name and title, business phone number, event capacity, and a brief description of their venue.

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@fancav.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your credentials.

2.4 One Account Per Person

Personal accounts are limited to one account per individual. Creating multiple accounts to circumvent platform rules, limits, or bans is prohibited and will result in immediate termination of all associated accounts.

3. Phone Number Verification

All users — personal and business — are required to verify a valid U.S. mobile phone number at signup via a one-time SMS code (OTP). Verification must be completed before you can access the platform. This requirement exists to confirm you are a real person with an active phone number and to maintain baseline trust across the community.

By providing your phone number and completing verification, you consent to receive a one-time verification SMS from Fancav at the number provided. Standard message and data rates may apply depending on your carrier.

4. User Conduct

By using the Service, you agree not to:

  • Provide false, misleading, or inaccurate information at signup or anywhere on the platform
  • Create fake, duplicate, or impersonation accounts
  • Use the Service if you are under 18 years of age
  • Post or submit content that is offensive, explicit, harassing, threatening, discriminatory, or otherwise in violation of our Community Guidelines
  • Use the platform to solicit or engage in any illegal activity
  • Scrape, crawl, or otherwise extract data from the Service without written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service for any commercial purpose not expressly permitted under a business account

Any violation of these Terms may result in immediate termination of your account, at our sole discretion and without prior notice.

5. Watch Party Events

5.1 Hosting

Personal account holders may create watch party events for sports games associated with their followed teams. Personal hosts are limited to a maximum of 20 attendees per event and may not create more than 7 events within any 24-hour rolling window.

Business account holders may create events without a platform-imposed attendee cap — the maximum attendees is set by the business based on venue capacity.

By hosting an event, you represent that:

  • The event will take place at the address you provide
  • You have the right to host guests at that location
  • The event information you submit is accurate
  • You will comply with all applicable local laws and regulations, including any rules governing gatherings at your location

5.2 Attending

Users may RSVP to events for teams they follow, subject to the event's visibility settings and the host's capacity limit. Each RSVP is personal and non-transferable. All attendees must hold an active, verified Fancav account. Users may not bring guests, plus-ones, or any individuals who have not independently RSVPd through the platform. Doing so violates the host's stated capacity limit and these Terms.

By RSVPing to an event, you commit to attending or withdrawing your RSVP in advance if your plans change. Repeated no-shows may result in account restrictions.

Users may not RSVP to their own events.

5.3 Event Cancellation

Hosts may cancel their event at any time before it starts. All confirmed attendees will be notified by email. Fancav reserves the right to cancel any event that violates these Terms.

5.4 Event Visibility

Hosts may set event visibility to Team (visible to followers of that specific team), League (visible to followers of any team in the same league), or Open (visible to all users). All visibility settings are still subject to distance radius filtering.

6. Platform Role; Assumption of Risk

6.1 Fancav Is a Marketplace, Not a Party to Events

Fancav is an online platform that connects sports fans who wish to host or attend watch party events. We are not a party to any event, agreement, or interaction between users. We do not own, operate, manage, or control any event listed on the platform. We do not supervise, direct, or monitor any in-person gathering facilitated through the Service.

By using the Service, you acknowledge and agree that Fancav's role is limited to providing technology that enables users to find and connect with one another. All in-person interactions, events, and gatherings take place entirely between users and are outside of Fancav's control.

6.2 No Identity Verification Guarantee

Fancav does not independently verify the real-world identity, background, character, or intentions of any user. While we require phone number verification at signup, this confirms only that a user has access to a real mobile phone — it is not a background check, identity document verification, or guarantee of any user's trustworthiness or conduct. We cannot and do not guarantee that any user is who they claim to be.

We encourage all users to exercise good judgment, take reasonable precautions, and use common sense before hosting or attending any event through the platform.

6.3 Assumption of Risk — All Users

You acknowledge that using the Service to find, host, or attend watch party events carries inherent risks, including but not limited to property damage, personal injury, theft, and interactions with strangers in private or semi-private settings. You voluntarily and knowingly assume the entire risk arising out of your use of the Service and any in-person interaction with other users, whether facilitated on or off the platform.

You agree that you are solely responsible for your own interactions with other users. Fancav is not responsible for the conduct of any user, whether online or offline. By using the Service, you agree to accept these risks and agree that Fancav is not responsible for the acts or omissions of any user on or off the platform.

6.4 Assumption of Risk — Hosts Specifically

If you host a watch party event, you acknowledge that you are inviting individuals you may not know into your home or property. You assume full responsibility for:

  • Vetting attendees to your own satisfaction before granting access to your property
  • Ensuring your property is safe and suitable for guests
  • Complying with any applicable laws or regulations governing gatherings at your location
  • Any damage to your property caused by attendees
  • Any injury to attendees or third parties occurring at your event

Fancav does not provide host liability insurance, property damage protection, or any other insurance in connection with watch party events. We strongly encourage personal hosts to consult with their homeowner's or renter's insurance provider before hosting events.

6.5 Assumption of Risk — Attendees Specifically

If you RSVP to and attend a watch party event, you acknowledge that you are entering property owned or controlled by another user who is not affiliated with Fancav. You assume full responsibility for:

  • Assessing the safety and appropriateness of any event before attending
  • Your conduct while at the event
  • Any personal injury, property damage, or loss you suffer in connection with attending the event

Fancav is not responsible for conditions at any event location, the conduct of any host, or any harm you experience as an attendee.

6.6 Address Privacy

For personal host events, the full street address of the event is not displayed to users until 24 hours before the event start time. Prior to that window, only the general neighborhood or city district is shown. The full address is revealed only when both of the following conditions are met:

  1. The current time is within 24 hours of the event start time
  2. The requesting user is either the event host or has a confirmed RSVP status

This logic is enforced at the database level. Users who have withdrawn their RSVP are treated as non-attendees and do not have access to the full address, regardless of timing.

For business-hosted events, the full venue address is always visible, as the venue is a public location.

7. Gender Preference Setting

7.1 Overview

Fancav offers an optional gender preference setting that allows personal users to express a preference for hosting or attending watch party events with users of the same gender. This setting exists solely as a personal safety and private property access preference — it is not a platform policy, not a commercial service restriction, and not a statement by Fancav about any user's value or standing on the platform.

This setting is entirely voluntary, defaults to off, and may be enabled or disabled at any time in profile settings. Fancav does not require, encourage, or incentivize users to enable this setting.

7.2 How It Works

When a personal user enables the gender preference setting:

  • As a host: Their event remains visible to all eligible users in the feed and on the map, but RSVP is limited to users of the same gender. Users who are not eligible to RSVP are shown a clear, respectful explanation on the event detail page.
  • As an attendee: Their event feed prioritizes events hosted by users of the same gender. Users with this setting enabled may still see and attend events where the host has not enabled gender preference.

This is a preference feature, not a guarantee. Availability of matching users depends on who is hosting or attending events in a given area at a given time.

7.3 Private Property Context

Watch party events hosted by personal users take place at private residential addresses. Fancav recognizes that individuals have a lawful interest in controlling who they invite into their private home. The gender preference setting is designed to support that interest in a personal safety context — analogous to a host's general right to decide who they welcome into their residence.

Nothing in this setting constitutes an endorsement by Fancav of any form of discrimination in any commercial, public accommodation, or employment context.

7.4 Non-Binary Users

The gender preference setting is inclusive of non-binary users. Non-binary users who enable this setting will see only events from hosts who have not enabled gender preference, ensuring they are never excluded from events they are eligible to attend. Non-binary hosts who enable the setting do not restrict RSVP eligibility, as the setting is designed around binary gender matching only — non-binary hosts' events remain open to all eligible users.

7.5 Scope and Limitations

Gender preference settings apply to future events only. Events already created retain the setting that was active at the time of creation. Changes to this setting do not retroactively affect existing events.

Gender preference interacts with all event visibility settings (Team, League, Open) — eligibility under both the visibility setting and the gender preference setting must be met for a user to RSVP.

Business accounts do not have access to the gender preference setting. Business events are open to all eligible users regardless of gender.

8. Content Standards and Moderation

8.1 User-Submitted Content

You are solely responsible for all content you submit to the platform, including event titles, descriptions, and comments. By submitting content, you grant Fancav a non-exclusive, royalty-free, worldwide license to display and distribute that content in connection with the Service.

8.2 Prohibited Content

You may not submit content that:

  • Is sexually explicit, graphic, or violent
  • Is harassing, threatening, or discriminatory
  • Is off-topic, spam, or unrelated to sports and watch party events
  • Violates any applicable law or third-party rights

8.3 Automated Moderation

All free-form text submissions — including event titles, descriptions, and comments — are screened by automated content moderation tools before being published. Content that triggers moderation filters will be rejected with a user-facing error. Fancav does not disclose which specific words or phrases triggered a rejection.

8.4 Reporting

Users may report events or other users directly from within the app. All reports are reviewed by our team. We reserve the right to remove content, suspend accounts, or take other appropriate action in response to reports, at our sole discretion. Any violation of these Terms identified through the reporting process may result in immediate termination of the offending account.

9. RSVP Approval and Waitlists

Hosts may enable manual RSVP approval, requiring them to approve or decline each RSVP request. When enabled, users receive a "pending" status until the host acts. Hosts are not required to provide a reason for declining a request.

Approved RSVPs trigger a confirmation email to the attendee. Declined RSVPs trigger a notification to the attendee.

10. Comments

Confirmed RSVP attendees and the event host may post comments on an event's detail page. Comments are visible to all users who can view the event. Only first names are displayed — no last name, email, or other personally identifiable information is shown.

The host may delete any comment on their event. Users may delete their own comments. Fancav reserves the right to remove any comment that violates these Terms, and such violations may result in immediate termination of the offending account.

11. Privacy

Your use of the Service is subject to our Privacy Policy, available at fancav.com/legal/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

12. Intellectual Property

The Service, including its design, code, content, and trademarks, is owned by Fancav and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

You retain ownership of content you submit. By submitting content, you represent that you have the right to do so and that your content does not infringe any third-party rights.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

FANCAV DOES NOT VERIFY THE IDENTITY, BACKGROUND, CRIMINAL HISTORY, OR INTENTIONS OF ANY USER. WE DO NOT GUARANTEE THE ACCURACY OF ANY EVENT LISTING. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER ON OR OFF THE PLATFORM. ATTENDING OR HOSTING A WATCH PARTY THROUGH THE SERVICE IS DONE ENTIRELY AT YOUR OWN RISK, AS DESCRIBED IN SECTION 6.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FANCAV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR ANY HARM ARISING FROM INTERACTIONS WITH OTHER USERS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FANCAV IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fancav and its officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your use of the Service; (b) any content you submit; (c) any event you host or attend through the platform; (d) your violation of these Terms; (e) your violation of any applicable law or third-party rights; or (f) any injury, damage, or loss suffered by any attendee, host, or third party in connection with an event you organized or attended.

16. SMS Terms

Program Description: Fancav uses SMS to send one-time verification codes (OTP) to users at signup to confirm their phone number. We may also send transactional SMS messages related to events you host or attend, such as time-sensitive notifications.

Message Frequency: You will receive an SMS verification code at signup. Additional transactional SMS messages may be sent in connection with your event activity. Message frequency varies.

Opt-Out: To stop receiving SMS messages from Fancav, reply STOP to any message we send. You will receive a confirmation that you have been unsubscribed. Opting out of transactional SMS messages may limit your ability to use certain features of the Service.

Help: For help, reply HELP to any message or contact us at legal@fancav.com.

Carriers: Carriers are not responsible for delayed or undelivered messages. Fancav is also not responsible for delays or failures in SMS delivery caused by carrier network conditions, technical failures, or other factors outside our control.

Cost: Message and data rates may apply. You are responsible for any fees charged by your mobile carrier.

Privacy: Your phone number and SMS opt-in status will not be shared with or sold to third parties. See our Privacy Policy at fancav.com/legal/privacy for full details.

17. Termination

Fancav may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases.

You may delete your account at any time from your profile settings. Upon confirmed deletion, your personal data will be purged in accordance with our Privacy Policy.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.

Informal Resolution First: Before filing any formal claim, you agree to contact us at legal@fancav.com and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days of receiving notice.

19. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fancav regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
